Article 3 – Applicability
These General Terms and Conditions apply to any offer by the entrepreneur and any distance contract and order concluded between the entrepreneur and the consumer. Before concluding a distance contract, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the contract that the General Terms and Conditions can be consulted at the entrepreneur's premises and will be sent free of charge upon the consumer's request.
If the contract is concluded electronically, as an exception to the previous paragraph and before the conclusion of the distance contract, the text of the General Terms and Conditions can be made available to the consumer in electronic format, so that the consumer can easily store it on a durable medium. If this is not reasonably possible, it will be indicated before the conclusion of the contract where the General Terms and Conditions can be consulted electronically and that they will be sent free of charge upon request.
If, in addition to these General Terms and Conditions, specific conditions for products or services apply, the second and third paragraphs apply mutatis mutandis, and the consumer may always invoke the more favorable provision in case of conflict between general conditions.
If one or more provisions of these General Terms and Conditions are wholly or partially void or annulled, the contract and the remaining conditions remain valid, and the provision in question will be replaced by mutual agreement with a provision as close as possible to the original purpose.
Situations not covered by these General Terms and Conditions will be evaluated according to their spirit.
Any ambiguity in interpreting or understanding one or more provisions of our terms must be interpreted according to the spirit of these General Terms and Conditions.
Article 4 – The Offer
If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.
The offer is non-binding. The entrepreneur has the right to modify and adapt the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is detailed enough to allow the consumer to make a proper evaluation. If the entrepreneur uses images, these faithfully represent the products and/or services offered. Obvious errors or inaccuracies in the offer do not bind the entrepreneur.
All images, specifications, and information in the offer are indicative and cannot constitute grounds for compensation or contract cancellation.
Product images faithfully represent the products offered. The entrepreneur cannot guarantee that the colors shown exactly match the actual product colors.
Each offer contains clear information on the consumer's rights and obligations when accepting the offer, in particular:
-
Price, excluding import taxes and VAT;
-
Any shipping costs;
-
How to conclude the contract;
-
Applicability of the right of withdrawal;
-
Payment, delivery, and contract execution methods;
-
The deadline for accepting the offer or the period during which the entrepreneur guarantees the price;
-
Any distance communication costs;
-
Contract storage and consultation methods;
-
Possibility to check and correct information before concluding the contract;
-
Languages in which the contract can be concluded besides Italian;
-
Codes of conduct respected by the entrepreneur and how to consult them electronically;
-
Minimum duration of a distance contract in case of a continuing transaction;
-
Optional: sizes, colors, available materials.
Article 5 – The Contract
The contract is concluded, subject to the provisions of the previous article, when the consumer accepts the offer and meets the corresponding conditions.
If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm electronically the receipt of acceptance. Until confirmed, the consumer can withdraw from the contract.
The entrepreneur will take technical and organizational measures to ensure secure electronic transmission and web environment.
The entrepreneur may verify, within legal limits, the consumer's ability to fulfill payment obligations and assess relevant factors for responsibly concluding the distance contract.
The entrepreneur will provide the consumer, at the latest upon delivery, with written or durable medium information:
-
Entrepreneur's address for complaints;
-
Conditions and procedures for exercising the right of withdrawal;
-
Warranty and after-sales service information;
-
Data from Article 4, paragraph 3;
-
Requirements for terminating contracts longer than one year or indefinite contracts.
Each contract is concluded under the suspensive condition of product availability.
Article 6 – Right of Withdrawal
The consumer can withdraw from the contract without reason within 30 days of purchase. The period starts the day after the product is received by the consumer or a designated representative.
During this period, the consumer must handle the product with care and may open or use it only as necessary to evaluate whether to keep it. In case of withdrawal, the product must be returned with all accessories and, if possible, in the original packaging according to the provided instructions.
The consumer may exercise the right of withdrawal using the standard form or another clear statement.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer. The entrepreneur will refund all amounts received, including shipping costs, within 14 days of the withdrawal declaration.
The refund may be suspended until the product is received or proof of return is provided, whichever occurs first.
Article 8 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the right of withdrawal if clearly stated in the offer and only if the consumer was informed before the contract was concluded.
Article 9 – Price
Prices indicated in the offer remain valid unless legally adjusted. Unstated price errors may result in order cancellation or special conditions.
Article 10 – Conformity and Warranty
The entrepreneur guarantees that products and/or services comply with the contract, offer specifications, and reliability and usability requirements. Any additional warranties will be clearly communicated.
Article 11 – Delivery and Execution
Orders are processed with utmost care in the order received unless otherwise agreed. Delivery will occur within 30 days unless otherwise communicated.
Article 12 – Payment Methods
Unless otherwise agreed, payment must be made immediately. Any billing discrepancies must be reported immediately.
Article 13 – Complaints
The entrepreneur has a complaint procedure and will respond within 14 days. If unsatisfied, the consumer may contact:
-
The competent consumer protection authority;
-
An arbitration court.
Article 14 – Applicable Law
These General Terms and Conditions and all contracts concluded based on them are governed by the law of the United Kingdom (UK).
Article 15 – Modification of the General Terms and Conditions
The entrepreneur may modify the General Terms and Conditions. Changes will be communicated to the consumer at least 30 days before they take effect.
